2.2 Independent Businesses

Every restaurant, café, bakery, coffee shop, food business, service provider, advertiser, merchant, or other third-party business (“Listed Business”) is solely responsible for its own:

  • Food and beverages;
  • Ingredients and allergens;
  • Food preparation;
  • Hygiene and safety;
  • Prices;
  • Offers and promotions;
  • Availability;
  • Opening and closing hours;
  • Licences and permits;
  • Employees and representatives;

  • Deliveries;
  • Reservations;
  • Payments;
  • Refunds;
  • Cancellations;
  • Complaints;
  • Legal and regulatory compliance; and
  • Statements, representations, and information submitted to KhushMaza.com.

KhushMaza.com does not assume responsibility for any of the above.

3. NO AGENCY, PARTNERSHIP OR REPRESENTATION

4. NO INVOLVEMENT IN TRANSACTIONS

If you contact, visit, order from, purchase from, reserve with, communicate with, pay, or otherwise transact with a Listed Business, your relationship and transaction are directly between you and that Listed Business.

  • Whether food is prepared correctly;

  • Wrong orders;
  • Missing items;
  • Payments;
  • Refunds;
  • Cancellations;
  • Complaints;
  • Customer service;
  • Damages;
  • Losses;
  • Disputes;

  • Breach of contract;
  • Illegal activity by a Listed Business; or
  • Any other matter arising from dealings between users and Listed Businesses.

Any dispute arising from a transaction with a Listed Business must be addressed directly with that business, subject to applicable law.

Businesses may submit, create, claim, modify, or maintain profiles and information on KhushMaza.com.

Business information may include:

  • Cuisine;
  • Menu information;
  • Food specialties;
  • Photos;
  • Videos;
  • Descriptions;
  • Offers;
  • Services;
  • Prices;

  • Contact information; and
  • Other business-related information.

The Listed Business submitting or claiming such information is solely responsible for ensuring that the information is accurate, lawful, current, complete, and not misleading.

KhushMaza.com does not guarantee the accuracy, completeness, legality, authenticity, availability, or currency of information submitted by third parties.

6. NO GUARANTEE OF BUSINESS INFORMATION

Business listings are provided for general informational and discovery purposes.

Information displayed on the Platform may:

  • Be supplied by third parties;
  • Be automatically generated or processed;

8. NO ENDORSEMENT

This obligation applies to the maximum extent permitted by applicable law.

16. USER INDEMNIFICATION

To the maximum extent permitted by law, the total aggregate liability of KhushMaza.com and the Protected Parties arising from or relating to the Platform shall be limited to the amount actually paid by the relevant user to KhushMaza.com for the specific Service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.

Where no amount was paid, the maximum aggregate liability shall, to the extent permitted by law, be AED 100.

Nothing in this section limits liability where such limitation is prohibited by mandatory applicable law.

32. FORCE MAJEURE

KhushMaza.com and the Protected Parties shall not be responsible for failure or delay caused by circumstances beyond reasonable control, including:

You understand that Listed Businesses are independent third parties.

You agree that you are responsible for conducting your own verification and due diligence before relying upon information, visiting a business, purchasing products or services, ordering food, making reservations, providing personal information, or entering into any transaction with a Listed Business.

You further acknowledge that KhushMaza.com does not guarantee the accuracy, safety, legality, quality, availability, reliability, or performance of Listed Businesses or their products and services.

39. PROTECTION OF KHUSHMAZA.COM AND ITS PEOPLE

To the maximum extent permitted by applicable law, all protections, exclusions, disclaimers, limitations, indemnities, and rights contained in these Terms shall apply to:

  • Its owners;
  • Founders;
  • Shareholders;
  • Directors;
  • Managers;
  • Officers;
  • Employees;
